There is a difference between
criminal law and civil law. In a criminal case a prosecutor,
as representative of the injured community, initiates and controls
the case and the defendant is entitled to representation by a court
appointed attorney if necessary.
The same action may violate both
criminal and civil laws. In that case, a defendant may be criminally
prosecuted by the state and civilly sued by a victim for monetary
damages.
The American criminal justice system
is complex and becoming more so. Many acts, acceptable at one
time in America (e.g. punishment of a child, drinking while driving,
or sexual harassment) are now criminalized. American law
reflects the social concerns of citizens of the U.S. even to degrees
of guilt. In recent years, the U.S. Supreme Court has also
found that Congress had no authority under the Constitution to
create certain federal crimes (e.g. forbidding the sale of
firearms within a certain distance of schools, allowing rape
prosecutions in federal court).
Under United States Criminal Law,
crimes are generally divided into felonies and misdemeanors with the
potential punishment as the determining factor.
If a law is punishable by
imprisonment for longer than a year, the crime is usually considered
a felony. A misdemeanor’s potential punishment is for a year or
less. Some crimes are called "wobblers," as sentence may
be imposed by a judge who has the legal discretion of imposing a
sentence of less than a year thereby determining the class of crime
(misdemeanor or felony).
Actions punishable only by fine are usually considered infractions
and not crimes at all.
In more recent times, it has become
the norm to classify crimes as "white collar" or
"violent".
White collar crime
is a term generally
used to describe non-violent crime committed by corporations, their
employees and officers, and individuals. Examples of white collar
crime would be: bribery, extortion, embezzlement, securities
fraud, theft and other violations of trust committed in the course
of employment or business practices, including bribery, government
contract fraud, insider trading, mail fraud, perjury and false
declarations, price-fixing, racketeering, RICO , and stock
manipulation among others.
Violent crimes in the U.S.
would include arson, assault, battery, child abuse, domestic
violence, homicide, mayhem, murder, rape, and robbery among others.
Legally allowed defenses in a criminal case:

Arguing that the prosecutor failed to prove his or her case

Arguing innocence

Claiming temporary or permanent impairment (insanity,
influence of drugs or alcohol )

Self-Defense

Alibi
-
Entrapment

Age (minor at the time of commission)
Derivative liability: most states do not make any
distinction between the criminal liability of crime perpetrators and
their accomplices. Punishment can be equal, for both the
perpetrator of a crime, the accomplice, accessory, or aider
and abettor.
